shall apply to the same terms and phrases which are used in the prevailing <br />wage requirements of this subsection. <br />9. ARCHITECTURAL CONTROL <br />The design of all improvements shall be subject to prior review and approval by City. <br />10. TITLE TO IMPROVEMENTS <br />All improvements made to the demised premises shall be and remain the property of <br />Lessee until termination of this lease, whether by expiration of the term, cancellation, <br />forfeiture or otherwise and, upon such termination, all such improvements shall be <br />and become the property of City and shall remain upon and be surrendered with the <br />premises as part thereof. <br />11. CONDITION AND MAINTENANCE OF PREMISES, <br />IMPROVEMENTS, EQUIPMENT FURNISHINGS AND PERSONNEL <br />Lessee shall provide and maintain, at its own cost and expense, throughout the entire <br />term of this lease, any and all equipment, fixtures, furniture and furnishings necessary <br />for use in and about the demised premises and shall hire and properly train all <br />personnel necessary to maintain and operate thereon a first class hotel. <br />Lessee shall, at its own cost and expense, during the entire term hereof, keep and <br />maintain the demised premises and all improvements thereon in good order and <br />repair and in clean, presentable, and tenantable condition, injury thereto or <br />destruction thereof by fire, flood, earthquake, act of God or other cause beyond the <br />control of the Lessee excepted. Lessee hereby expressly waives the right to make such <br />repairs at the expense of City and the benefit of the provisions of Sections 1941 and <br />1942 of the Civil Code of the State of California relating thereto. <br />Any trade fixtures, signs and other personal property of the Lessee, not affixed to the <br />premises shall remain the property of Lessee and the City agrees that the Lessee shall <br />have the right, provided the Lessee is not in default under the terms of this lease, at <br />any time, and from time to time, to remove any and all of its trade fixtures, signs and <br />other personal property, which it may have stored or installed in the premises, <br />including but not limiting the same to furniture, bedding, portable appliances, <br />telephone equipment, televisions, radios, and other movable personal property. Light <br />fixtures, sign structures, carpets, drapes, partitions, built-in equipment and appliances <br />and similar items are improvements and shall not be considered to be personal <br />property of Lessee. Lessee shall, without request or approval from City, periodically <br />replace light fixtures, carpets, drapes, built in equipment and appliances and similar <br />improvements as necessary to properly maintain and renovate the premises as <br />14 <br />
