will take affirmative action to ensure that applicants for <br />employment are employed, and that employees are treated during <br />employment, without regard to their race, color, religion, <br />handicap, sex, sexual orientation, age, or national origin. Such <br />action shall include but not be limited to the following: <br />employment; upgrading; demotion or transfer; recruitment or re- <br />cruitment advertising; layoff or termination; rates of pay or other <br />forms of compensation; and selection from training, including <br />apprenticeship. <br />Contractor will incorporate the above Affirmative Action <br />provisions in all subcontracts for work covered by this Agree- <br />ment. <br />B. Minority and Female -owned Business Enterprises <br />In connection with the performance of this Agreement, Contractor shall <br />comply with the City and Federal Governments' current policies and use <br />its best efforts to obtain the maximum utilization of minority -owned <br />business enterprises based in San Leandro and ensure that minority and <br />female -owned enterprises based in San Leandro shall have maximum <br />practicable opportunity for subcontractor work under this Agreement. <br />2. Contractor shall insert similar provisions in all subcontracts for work <br />covered by this Agreement. <br />C. General Employment Provisions Relating to HandicVMisability Discrimination <br />for CDBG Contractors <br />1. General prohibitions against employment discrimination. <br />a) No qualified individual with a handicap or a disability shall, <br />solely on the basis of such handicap or disability, be subjected to <br />discrimination in employment by a contractor receiving Federal <br />financial assistance as part of the CDBG program. <br />b) The contractor may not limit, segregate, or classify applicants or <br />employees in any way that adversely affects their opportunities or <br />status because of handicap or disability. <br />c) Prohibition against discrimination in employment by the <br />contractor applies to the following activities: recruitment, <br />advertising, processing of applications for employment; hiring, <br />upgrading, promotion, award of tenure, demotion, transfer, layoff, <br />termination, right of return from layoff, injury or illness, and <br />rehiring; rates of pay or any other form of compensation and <br />Exhibit E <br />Page 2 of 7 <br />
