The amount of just compensation for the property being condemned, including <br />compensation for all future uses to which Albany may put the property pursuant to the rights obtained <br />in this action, together with all costs and litigation expenses, if any, to which PG&E may be entitled, and <br />including interest, shall be $188,233.50, less the deposit of $63,201.00 (previously withdrawn by <br />PG&E). This net sum shall accrue interest commencing January 5, 1998 to the date of payment at the <br />rate of $19.12 per day until paid. <br />14. The parties have waived their rights to appeal from this judgment. <br />C. Fremont. <br />15. Fremont is a municipal corporation and is authorized by Section 37350.5 of the <br />Government Code to condemn for the purposes of the project described in the complaint. <br />16. The project is a public use, to wit: provision of street lighting service. <br />17. The public interest and necessity require this project. <br />18. The project is planned and located in a manner that will be most compatible with the <br />greatest public good and least private injury. <br />19. The property sought in this action is necessary for the project. <br />20. The amount of just compensation for the property being condemned, including <br />compensation for all future uses to which Fremont may put the property pursuant to the rights obtained <br />in this action, together with all costs and litigation expenses, if any, to which PG&E may be entitled, and <br />including interest, shall be $205,290.13, less the deposit of $148,492.00 (previously withdrawn by <br />PG&E). This net sum shall accrue interest commencing January 5, 1998 to the date of payment at the <br />rate of $8.68 per day until paid. <br />21. The parties have waived their rights to appeal from this judgment. <br />D. Hayward. <br />22.
