Article Nine: ECONOMIC DEVELOPMENT LOAN <br />9.01 A en s Assistance. <br />Agency has assisted Developer in obtaining a San Leandro Economic <br />Development Agency ("EDA') Loan in an amount approximately equal to Nine <br />Hundred Thousand Dollars ($900,000) for a five (5) year term, at no interest, and <br />with payment of all principal due at the end of the term to purchase 1302 Marina <br />Boulevard. Agency shall provide further assistance to Developer by helping <br />Developer obtain a second EDA loan to pay half of the total cost of acquiring existing <br />easements at 1152 Marina Boulevard and acquiring a new easement at 2000 Wayne <br />Avenue to replace the extinguished easements. The Agency shall also assist <br />Developer in obtaining an EDA grant to pay the other half of the total cost of <br />acquiring existing easements at 1152 Marina Boulevard and acquiring a new <br />easement at 2000 Wayne Avenue to replace the extinguished easements. Total cost <br />to Developer shall include, and not be limited to, one-half (1/2) of the actual cost of <br />extinguishing existing and acquiring new easements, administrative costs, and legal <br />fees, and court costs, if any. <br />Article Ten: RESTRICTION OF ACCESS ONTO WAYNE AVENUE <br />10.01 Agency Assistance. <br />Agency shall schedule and notice public meetings and shall meet with property <br />owners on and around Wayne Avenue to discuss access and restriction devices for <br />Wayne Avenue. Agency shall use its best efforts to have the City of San Leandro <br />carry out the restriction of Wayne Avenue as required for the successful use of the <br />Improvements. Agency acknowledges that further development, in addition to the <br />Improvements, may result in a re-evaluation of traffic circulation patterns on Wayne <br />Avenue. <br />Article Eleven: GENERAL MOTORS CORPORATION PARKING <br />11.01 Developer Obtains Parking Commitment. <br />Developer shall use its best efforts to obtain an agreement with General <br />Motors Corporation, which may include the Agency leasing or subleasing property <br />with Agency's costs to be paid by Developer, which will allow Developer to enter, <br />Disposition and Development Page 26 of 39 <br />Agreement (Automall) <br />10/2/96 <br />
