IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO.96- 17 6 (19 7 7 / 10 9 8 ) <br />RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN LEANDRO APPROVING A MITIGATED NEGATIVE DECLARATION <br />FOR A CONFERENCE CENTER FACILITY WITH OVERNIGHT ACCOMMODATIONS <br />AT 30 SAN LEANDRO MARINA <br />WHEREAS, an Initial Study and Mitigated Negative Declaration were prepared in August <br />of 1996 and circulated for public review from August 19 to September 17, 1996. The City Council <br />has received copies of the Initial Study and the Mitigated Negative Declaration; and <br />WHEREAS, the Board of Zoning Adjustments held a public hearing for a Conditional Use <br />Permit for the Marina Conference Center with overnight accommodations on September 5, 1996 <br />and received public comments; and <br />WHEREAS, oral and written comments were received during the public comment period <br />which concluded on September 17, 1996 and were responded to in a Response to Comments report <br />which the City Council received. <br />NOW, THEREFORE, the City Council of the City of San Leandro does resolve as follows: <br />1. That, pursuant to the California Environmental Quality Act, the City Council makes the <br />following findings: <br />That the City Council finds that the City Council has conducted an independent <br />analysis of the adequacy of the proposed Mitigated Negative Declaration. <br />II. That the City Council finds that, on the basis of the following specific findings, that <br />the Marina Conference Center will not have a significant effect on the environment: <br />a. SEISMIC EVENTS <br />EFFECT: This project area lies within three and one-half (3-1/2) miles of <br />the Hayward Fault and is within a seismically active area. In the event of a <br />major earthquake on the Hayward, San Andreas or other nearby fault, <br />structures or persons in the area would be exposed to damage or risk <br />depending on the magnitude and nature of the earthquake. <br />
