IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO.96- 17 6 (19 7 7 / 10 9 8 ) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO APPROVING A MITIGATED NEGATIVE DECLARATION FOR A CONFERENCE CENTER FACILITY WITH OVERNIGHT ACCOMMODATIONS AT 30 SAN LEANDRO MARINA WHEREAS, an Initial Study and Mitigated Negative Declaration were prepared in August of 1996 and circulated for public review from August 19 to September 17, 1996. The City Council has received copies of the Initial Study and the Mitigated Negative Declaration; and WHEREAS, the Board of Zoning Adjustments held a public hearing for a Conditional Use Permit for the Marina Conference Center with overnight accommodations on September 5, 1996 and received public comments; and WHEREAS, oral and written comments were received during the public comment period which concluded on September 17, 1996 and were responded to in a Response to Comments report which the City Council received. NOW, THEREFORE, the City Council of the City of San Leandro does resolve as follows: 1. That, pursuant to the California Environmental Quality Act, the City Council makes the following findings: That the City Council finds that the City Council has conducted an independent analysis of the adequacy of the proposed Mitigated Negative Declaration. II. That the City Council finds that, on the basis of the following specific findings, that the Marina Conference Center will not have a significant effect on the environment: a. SEISMIC EVENTS EFFECT: This project area lies within three and one-half (3-1/2) miles of the Hayward Fault and is within a seismically active area. In the event of a major earthquake on the Hayward, San Andreas or other nearby fault, structures or persons in the area would be exposed to damage or risk depending on the magnitude and nature of the earthquake.
