COOPERATIVE AGREEMENT <br />CREEK AREA IMPROVEMENTS <br />FOR THE ROOT PARK PROJECT <br />(City Project No. 95-8687, District Zone No. 13) <br />THIS AGREEMENT is made and entered into on the 21 day of January <br />199 7 between the City of San Leandro, hereinafter referred to as "CITY" and <br />the Alameda County Flood Control and Water Conservation District, hereinafter <br />referred to as "DISTRICT", a local public agency of the State of California. <br />CITY and DISTRICT hereby agree as follows: <br />A. RECITALS AND PURPOSES <br />1. CITY is constructing significant improvements to Root Park, which is <br />located adjacent to San Leandro Creek at East 14th Street, hereafter <br />referred to as "PROJECT" <br />2. DISTRICT is proposing to provide financial assistance to CITY for <br />certain project improvements, those improvements being within the <br />creek waterway, and CITY will provide DISTRICT with easements for <br />flood control purposes over CITY -owned property where DISTRICT does <br />not currently hold easements. <br />3. Concurrent with this Agreement, CITY and DISTRICT shall enter into a <br />separate Access Agreement describing DISTRICT'S flood control <br />maintenance responsibilities for PROJECT creek area. <br />4. Both parties mutually desire to enter into a Cooperative Agreement for <br />said PROJECT improvements. <br />5. CITY and DISTRICT are authorized by acts governing them to engage in <br />the contemplated activities under this Agreement. <br />B. SCOPE OF WORK <br />The plans for "Root Park Improvements -Project No. 95-8687" dated March <br />1995 and the "Contract Book for Root Park Improvements -Project No. 95-8687" <br />are filed in DISTRICT's Maps & Files room under File No. UC-3060 and File No. <br />OF-190 respectively. Plans as modified during construction will be submitted <br />to DISTRICT by CITY as final Record Drawings. <br />CITY and DISTRICT shall carry out those activities respectively described <br />as follows: <br />CITY aorees to: <br />1. construct significant improvements to Root Park, located adjacent to <br />San Leandro Creek at East 14th Street. Park Improvements will include street <br />level work as well as creek overlooks, stairs down the creek -bed, a walkway <br />under the East 14th Street bridge, clearing and creek bank slope stabilization <br />followed by irrigation and native species planting within the creek area. <br />C�1 <br />
