SUPPORT AGREEMENT / WORK ORDER <br />PROJECT: San Leandro Marina Maintenance Dredging <br />PURPOSE AND AUTHORITY: This document, dated as of June 14, , 1997, is both a Support <br />Agreement (SA) and a Work Order (WO) entered into by and between the U.S. Department of the Army <br />(DA) and the City of San Leandro (City), a municipal corporation, acting by and through its City Council <br />pursuant to the Intergovernmental Cooperation Act and in accordance with the Memorandum of <br />Agreement (MOA) between the DA and the City executed on March 12, 1997. <br />MOA PROVISIONS: In accordance with the terms and conditions described in the MOA, the DA <br />and the City agree as follows: <br />1. Statement of Work: The Contractor shall mobilize adequate labor, equipment, and supplies and <br />make a determined and conscientious effort to complete the contract work within the time specified. <br />Prior to commencement of dredging, a dredging plan must be submitted for review and updated on a <br />weekly basis for timely notification to the Harbormaster of the dredging progress. The Contractor shall <br />sequence the dredging of the non -Federal marina areas as directed by the Contracting Officer and <br />maintain the dredge section to the neat pay lines shown on the drawings. Dredging shall be performed in <br />accordance with paragraph 6.1.1, section 02480-3 of the specifications, and in a manner, which will not <br />damage the structural integrity of the floating berths or pile support structures, or damage any vessels. <br />The Contractor shall be responsible for any and all damages to piers and boats caused as a result of his <br />operations. Dredged material is to be disposed of at the Government -furnished open water disposal site <br />Alcatraz (SF-11). <br />2. Schedule: The DA shall commence performance of the work described above upon written <br />notification from the City. The contract work shall be completed in not more than 100 calendar days <br />after the date the Contractor receives and acknowledges the notice to proceed. <br />3. Funding and Compensation: Payment of compensation to the DA shall be in a lump sum amount <br />for the total estimated cost identified for the work to be performed by the DA. The City agrees to pay all <br />identifiable direct and indirect costs associated with the DA's provision of goods and services. Payment <br />shall be made prior to commencement of work, in accordance with the terms and conditions specified in <br />the MOA. <br />4. Cost Accounting: Funding for the non -Federal work is in place as specified in the MOA. Based on <br />the successful low bidder's offer, the non -Federal dredging contract amount is $289,656. The following <br />is a current financial statement for the non -Federal, additive dredging project. The City has submitted a <br />total of $338,800 to the DA, as itemized below: <br />♦ Development & Administration of MOA ......... $4,000 (paid 24 Oct. 96) <br />♦ Development of Plans & Specs ....................... $14,000 (includes estimates and paid 19 Dec. 96) <br />♦ Non -Federal Additive Dredging ................... $320,800' (check dated 13 March 1997) <br />The remaining balance of $13,411 is reserved for project contingencies and possible contract <br />modifications, which would alter the final non -Federal contribution. <br />' This amount includes $289,656 non -Federal contract work; a Supervision & Administration cost of $18,633 (6.5% <br />flat rate x $286,656); and all additional costs associated with Aquatic Disposal: (Sampling and Testing Bioassay <br />Analysis = $9,000 ... Report Preparation = $2,500 ... Lab Coordination = $600 ... Environmental Documentation <br />Supplemental = $4,000 ... Environmental Administration = $1,000 ..... TOTAL = $17,100). <br />
