IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 97- 20 (1120 ) <br />RESOLUTION OF THE CITY COUNCIL OF THE <br />CITY OF SAN LEANDRO APPROVING THE <br />REUSE REPORT REQUIRED BY HEALTH &. SAFETY <br />CODE § 33433 FOR THE 1433-1445 EAST 14TH STREET <br />PROJECT OF THE PLAZA 1 REDEVELOPMENT <br />PROJECT AND THE FORM OF THE <br />DISPOSITION AND DEVELOPMENT AGREEMENT <br />BETWEEN THE EMPIRE REALTY GROUP, L.L.C. <br />AND THE REDEVELOPMENT AGENCY. <br />Recitals <br />WHEREAS, the Redevelopment Agency of the City of San Leandro <br />("Agency") has negotiated in good faith a form of the Disposition and Development <br />Agreement ("Agreement") between the Agency and the Empire Realty Group, L.L.C. <br />("Empire") where the Agency may acquire real property parcels in the Plaza I <br />Redevelopment Project Area ("Plaza I") area and convey one (1) of those parcels to <br />Empire, who shall then carry out tenant improvements and execute long term leases <br />for three (3) food and beverage retail establishments with national reputations <br />("Retail Development"); <br />WHEREAS, the Agreement places additional restrictions, covenants and <br />conditions on Empire regarding the Retail Development; <br />WHEREAS, the Agreement provides that the Agency may acquire parcels in <br />the Plaza I, which acquisition may be in whole or in part, directly or indirectly <br />financed with tax increment money, and one of the acquired parcels may then be <br />conveyed to Empire for an amount of consideration set forth in the Agreement; <br />WHEREAS, Agency has caused to be prepared a report required by Health and <br />Safety Code § 33433 ("Reuse Report") which contains a summary of the form of the <br />Disposition and Development Agreement ("Agreement") to be entered into between <br />the Agency and Empire and a summary of the cost of Agreement to the Agency, and <br />the Agency has made the Reuse Report available for public inspection pursuant to <br />
