IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 97- 20 (1120 ) RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN LEANDRO APPROVING THE REUSE REPORT REQUIRED BY HEALTH &. SAFETY CODE § 33433 FOR THE 1433-1445 EAST 14TH STREET PROJECT OF THE PLAZA 1 REDEVELOPMENT PROJECT AND THE FORM OF THE DISPOSITION AND DEVELOPMENT AGREEMENT BETWEEN THE EMPIRE REALTY GROUP, L.L.C. AND THE REDEVELOPMENT AGENCY. Recitals WHEREAS, the Redevelopment Agency of the City of San Leandro ("Agency") has negotiated in good faith a form of the Disposition and Development Agreement ("Agreement") between the Agency and the Empire Realty Group, L.L.C. ("Empire") where the Agency may acquire real property parcels in the Plaza I Redevelopment Project Area ("Plaza I") area and convey one (1) of those parcels to Empire, who shall then carry out tenant improvements and execute long term leases for three (3) food and beverage retail establishments with national reputations ("Retail Development"); WHEREAS, the Agreement places additional restrictions, covenants and conditions on Empire regarding the Retail Development; WHEREAS, the Agreement provides that the Agency may acquire parcels in the Plaza I, which acquisition may be in whole or in part, directly or indirectly financed with tax increment money, and one of the acquired parcels may then be conveyed to Empire for an amount of consideration set forth in the Agreement; WHEREAS, Agency has caused to be prepared a report required by Health and Safety Code § 33433 ("Reuse Report") which contains a summary of the form of the Disposition and Development Agreement ("Agreement") to be entered into between the Agency and Empire and a summary of the cost of Agreement to the Agency, and the Agency has made the Reuse Report available for public inspection pursuant to
