a commercial structure with nearly $1,000,000.00 in tenant <br />improvements; attracting other private investment, through the <br />establishment of these national chains; and developing the vacant <br />lot at 1433 East 14th Street into an improved parking lot with <br />pedestrian walkways and outdoor seating area. <br />III. The City Council finds that, on the basis of the following specific <br />finding, the sale of the property, which may be purchased in whole or in <br />part with tax increment revenues, set forth in the form of the <br />Disposition and Development Agreement between the Redevelopment <br />Agency of the City of San Leandro and Empire Realty Group, L.L.C. is <br />for an amount of consideration not less than fair consideration given the <br />restrictions, conditions and covenants requiring tenant improvements <br />and execution of long term leases with three (3) nationally known food <br />and beverage retailers. <br />(a) The Agency has caused Keyser Marston Associates, Incorporated, <br />to prepare a reuse appraisal of the property to evaluate the fair <br />value of the property given the restrictions, conditions and <br />covenants of the Agreement. The reuse appraisal has been <br />performed in a manner consistent with normally accepted <br />procedures of practitioners in the same field. The reuse appraisal <br />has concluded that Three Hundred Thirty -Five Thousand Dollars <br />($335,00.00) is the fair market value and fair reuse value for the <br />interests to be conveyed to Empire Realty Group, L.L.C. given the <br />Agreement's covenants and conditions requiring tenant <br />improvements and execution of long term leases with three (3) <br />nationally known food and beverage retailers. <br />BE IT FURTHER RESOLVED that <br />Section 1. The form of the Disposition and Development Agreement between <br />the Redevelopment Agency of the City of San Leandro and Empire Realty Group, <br />L.L.C., copies of which are on file in the office of the City Clerk is hereby approved. <br />Section 2. The Reuse Report required by Health and Safety Code § 33433, <br />copies of which are on file in the office of the City Clerk, and all related documents, <br />correspondence and transmittals are hereby approved. <br />
