a commercial structure with nearly $1,000,000.00 in tenant
improvements; attracting other private investment, through the
establishment of these national chains; and developing the vacant
lot at 1433 East 14th Street into an improved parking lot with
pedestrian walkways and outdoor seating area.
III. The City Council finds that, on the basis of the following specific
finding, the sale of the property, which may be purchased in whole or in
part with tax increment revenues, set forth in the form of the
Disposition and Development Agreement between the Redevelopment
Agency of the City of San Leandro and Empire Realty Group, L.L.C. is
for an amount of consideration not less than fair consideration given the
restrictions, conditions and covenants requiring tenant improvements
and execution of long term leases with three (3) nationally known food
and beverage retailers.
(a) The Agency has caused Keyser Marston Associates, Incorporated,
to prepare a reuse appraisal of the property to evaluate the fair
value of the property given the restrictions, conditions and
covenants of the Agreement. The reuse appraisal has been
performed in a manner consistent with normally accepted
procedures of practitioners in the same field. The reuse appraisal
has concluded that Three Hundred Thirty -Five Thousand Dollars
($335,00.00) is the fair market value and fair reuse value for the
interests to be conveyed to Empire Realty Group, L.L.C. given the
Agreement's covenants and conditions requiring tenant
improvements and execution of long term leases with three (3)
nationally known food and beverage retailers.
BE IT FURTHER RESOLVED that
Section 1. The form of the Disposition and Development Agreement between
the Redevelopment Agency of the City of San Leandro and Empire Realty Group,
L.L.C., copies of which are on file in the office of the City Clerk is hereby approved.
Section 2. The Reuse Report required by Health and Safety Code § 33433,
copies of which are on file in the office of the City Clerk, and all related documents,
correspondence and transmittals are hereby approved.
