(a) The Contractor shall not have control over or charge of and shall not be responsible for construction means, methods, techniques, sequences or procedures, or for safety precautions and programs in connection with the Work. (b) The Contractor shall not be responsible for the construction contractor's schedules or failure to carry out the Work in accordance with the Contract Documents. (c) The Contractor shall not have control over or charge of acts or omissions of the construction contractor's, it's subcontractors, or their agents or employees, or of any other persons performing portions of the construction contractor's Work. (d) The Contractor shall provide the services in a timely manner and in general conformance with the master schedule included in Exhibit B-1. (e) The Scope of Services does not include services, which may be required to be provided on account of "design suggestions", which may be selected by the City, from the Architectural -Peer Review document prepared for the Project. At such time the City selects the "design suggestions" to be incorporated into the scope of the Project the Contractor and the City shall determine a mutually agreeable scope of services to be provided by the Contractor on account of the selected "design suggestions". The Contractor and the City shall also determine if the service(s) to be provided by the Contractor, shall be provided as a basic service, without any additional compensation paid to the Contractor, or shall be provided as an extra or additional service, with additional compensation paid to the Contractor. The services to be provided, shall generally revise the architectural and the structural, mechanical and electrical engineering Schematic Design Phase documents, inclusive of drawings and outline specifications, to conform with the expressed intent of the selected "design suggestions".
