ARTICLE IX <br />UTILITIES <br />Section 9.1 Utilities <br />Tenant shall pay, or cause to be paid, at its sole cost and expense, all charges which <br />are incurred by Tenant, or which as a result of being incurred by Tenant, might be a charge <br />or lien against the Premises or Improvements for gas, water, sewers, electricity, light, heat <br />or power, or telephone or other communication service used, rendered or supplied upon or in <br />connection with the Premises, throughout the Term, and shall indemnify, defend, protect and <br />hold Landlord harmless from and against any liability or damages on such account. Tenant <br />also shall procure, or cause to be procured, without cost to Landlord, any and all necessary <br />permits, licenses, or other authorizations required for the lawful and proper installation and <br />maintenance upon the Premises and Improvements of wires, pipes, conduits, tubes, and other <br />equipment and appliances for use in supplying any such service to and upon the Premises, <br />provided that Landlord shall, at its cost, make all utilities available to the Premises prior to <br />Tenant's commencement of construction of the Improvements. <br />LEASE BETWEEN CITY OF SAN LEANDRO <br />AND SAN FRANCISCO BAY CONFERENCE RESORT PAGE 39 <br />2574001\313983.8 <br />
