pursuant to Article XXI. No such reduction in Base Rent shall affect any remaining <br />obligations of Tenant under Tenant's Note. <br />Section 12.6 Temporary Taking <br />If all or any portion of the Premises shall be taken by any competent authority for <br />temporary use or occupancy, this Lease shall continue in full force and effect without <br />reduction or abatement of Base Rent (except as otherwise provided in this Section 12.6), and <br />Tenant shall, in such event, be entitled to any award specifically made for the repair and <br />restoration of any damage to the Premises as a result of such temporary use or occupancy <br />and to the entire award for such Taking to the extent that the same shall be applicable to the <br />period of such temporary use or occupancy included in the Term and Landlord shall be <br />entitled to any remainder of the award. Notwithstanding the foregoing, if all or any portion <br />of the Premises shall be taken by the City of San Leandro for temporary use or occupancy, <br />Tenant's obligation to pay Base Rent shall be equitably reduced during the period of <br />temporary use or occupancy based on the extent to which the temporary use or occupancy <br />interferes with Tenant's use and operation of the Premises and the Improvements. <br />ARTICLE XIII <br />DEVELOPMENT OF THE PROPERTY <br />Section 13.1 Tenant's Development of Premises <br />In addition to the Improvements contemplated under the Development Agreement, <br />Tenant shall have the right, subject to all Applicable Laws and Government Requirements, <br />including without limitation, the California Environmental Quality Act and zoning <br />LEASE BETWEEN CITY OF SAN LEANDRO <br />AND SAN FRANCISCO BAY CONFERENCE RESORT PAGE 51 <br />2574001\313983.8 <br />
