shall surrender to Landlord the Premises and the Improvements in good order, condition, and <br />repair, reasonable wear and tear excepted, and free and clear of all liens and encumbrances <br />other than those, if any, permitted hereby or otherwise created or consented to by Landlord. <br />The Improvements shall, upon surrender, be and become the property of Landlord without <br />the necessity of further action, but Tenant shall, upon Landlord's request, execute, <br />acknowledge and deliver to Landlord such instruments of conveyance or of further assurance <br />as in the opinion of Landlord or its legal counsel are necessary or desirable to confirm or <br />perfect Landlord's right, title, and interest in and to the Premises and Improvements; <br />provided, however, that Tenant shall have no right to surrender the Premises except upon the <br />expiration of the Term or upon termination by Landlord pursuant to and subject to the <br />provisions of this Lease. <br />ARTICLE XV <br />INSURANCE <br />Section 15.1 Tenant's Obligation to Maintain Insurance <br />Tenant, at its sole cost and expense, shall cause insurance to be maintained as set <br />forth in Exhibit H which is incorporated herein by this reference. Should Tenant fail to <br />maintain any insurance or provide Landlord with evidence of the existence or renewal <br />thereof, as required, or should any policy expire or be cancelled before expiration of the <br />Lease and Tenant fails immediately to procure other insurance as specified, Landlord <br />reserves the right, but shall have no obligation, to procure such insurance and to receive <br />payment from Tenant for the cost thereof.
