requirements is to be construed as limiting either the type, quality or quantity of insurance <br />Tenant should maintain or the extent of Tenant's responsibility for payment of damages <br />resulting from its operations under this Lease. <br />Section 15.2 Requirements Regarding Insurance <br />All policies of insurance provided for in this Article XV shall be effected under <br />policies in such forms and amounts as may from time to time be issued by insurers of <br />recognized responsibility which are authorized to transact business in the State of <br />California and which have a general policyholder's rating of not less than " B + " and a <br />financial rating of not less than "VIII" in the most current Best's Key Rating Guide. Tenant <br />agrees to name Landlord as an additional insured on all liability policies required of Tenant <br />hereunder. Upon the execution of this Lease and thereafter, not less than thirty (30) days <br />prior to the expiration date of each policy furnished pursuant to this Article XV, a certificate <br />of insurance shall be delivered by Tenant to Landlord evidencing the insurance obtained. <br />Each policy of insurance required of Tenant shall contain, if obtainable, either (i) a waiver <br />by the insurer of the right of subrogation against Landlord or Tenant for the negligence of <br />such party or (ii) a statement that the insurance shall not be invalidated should any insured <br />waive in writing prior to a loss any or all right of recovery against any party for loss <br />described in the insurance policy. Tenant hereby waives any and all rights of recovery <br />against Landlord, and against its employees, agents and representatives, for loss or damage <br />to Tenant or its property or the property of others under its control, arising from any cause <br />insured against under the form of insurance policies required to be carried pursuant to this <br />LEASE BETWEEN CITY OF SAN LEANDRO <br />AND SAN FRANCISCO BAY CONFERENCE RESORT PAGE 56 <br />2574001\313983.8 <br />
