amounts herein required, and provided further that in all other respects any such policy or <br />policies shall comply with the other provisions of this Lease. In any such case Tenant shall <br />deliver to Landlord a certificate of such policy. <br />ARTICLE XVI <br />MECHANICS' LIENS <br />Section 16.1 Tenant's Obligation to Discharge Mechanics' Liens <br />During the Term, Tenant shall not permit to remain, and shall promptly discharge, at <br />its sole cost and expense, all liens, encumbrances, and charges (other than liens, <br />encumbrances, and charges created by or approved by Landlord) upon the Premises or <br />Improvements, or any part thereof; provided that the existence of any mechanics', laborers', <br />materialmen's, suppliers', or vendors' liens or rights thereto (collectively, "Mechanics' <br />Lien(s)") shall not constitute a violation of this Article XVI if payment is not yet due under <br />the contract which is the foundation thereof. Tenant, however, shall have the right to contest <br />with due diligence the validity or amount of any Mechanics' Lien. In the event any lien is <br />recorded and suit is timely filed, Tenant shall, upon demand, either furnish the bond <br />described in California Civil Code Section 3143, or successor statute, which results in the <br />removal of such a lien from the Premises, or provide other evidence satisfactory to Landlord <br />that such lien will be paid, removed, or discharged as a claim against the Premises. <br />Section 16.2 Notice to Landlord <br />Tenant shall give Landlord written notice of Tenant's intention to start construction of <br />any Improvements prior to the start of construction thereof.
