the uses of the Center, but shall not provide excessive parking such that much of the <br />parking is vacant a majority of the day or year consistent with the concept presented <br />to the City Council on June 30, 1997. The lot shall feature landscaping and other <br />site features to break up the expanse of asphalt. <br />4. Operation of the Creekside Center. <br />a) Maintenance. The Developer shall employ high quality maintenance to <br />maintain the buildings in at least equal condition to when they are constructed, <br />subject to acceptable normal wear and tear. Prior to the issuance of the Certificate of <br />Occupancy, for either the grocery store anchor tenant or the drug store tenant, the <br />Agency and Developer shall agree on a detailed set of standards for all required <br />maintenance, covering such items as cleaning of pedestrian areas, parking lot <br />cleaning, plant and tree condition, painting, awning replacement, parking lot <br />resurfacing, etc. The Developer shall develop a pest/rodent control program. The <br />Owner shall provide for maintenance services to be funded annually and for <br />replacement reserves for major building items to be funded annually. <br />b) Security. Prior to the issuance of the Certificate of Completion, for either <br />the grocery store anchor tenant or the drug store tenant, the Agency and Developer <br />shall agree on a detailed set of standards that provide for a top quality security <br />operation. On -site security staff shall be included. The Developer shall minimize <br />loitering and panhandling to the maximum extent allowed by law, in conjunction <br />with City programs. The site shall be well lit. <br />c) Management Company Approval. The Agency shall approve the <br />Management Company and such approval shall not be unreasonably withheld. It is <br />understood that Creekside Center Associates may be submitted as the proposed <br />management company for the Center, subject to the fee structure described in <br />Section 4.05(c) of the Disposition and Development Agreement. <br />J:\WPD\CSL\136\O1 WGREE\CREEKCN7DDAEXHIB.00B <br />M <br />
