Amended & <br />Reptated DDA approved by SLRA 07-17-00 <br />via SLRA Resolution No. 2000-25 <br />RESOLUTION NO. 97 -105 (1313-C) <br />A RESOLUTION OF THE CITY COUNCIL APPROVING A PLAN <br />AMENDMENT REPORT FOR THE PLAZA 2 REDEVELOPMENT <br />PLAIN, THE REUSE REPORT REQUIRED BY HEALTH S& SAFETY <br />CODE SECTION 33433 FOR THE CREEKSIDE CENTER PROJECT <br />AND THE FORIvi OF THE DISPOSITION AND DEVELOPIv1ENT . <br />AGREEMENT BETWEEN CREEKSIDE CENTER ASSOCIATES AND <br />THE REDEVELOPMENT AGENCY OF THE CITY OF SAN LEANDRO <br />WHEREAS, the Redevelopment Agency of the City of San Leandro <br />("Agency") has caused to be prepared a report on the Amendment to the Land <br />Utilization section of the Plaza 2 Redevelopment Plan to permit the use of the <br />property at 960 San Leandro Boulevard for "Retail Sales, Office Facilities or <br />Residential, and such report has been presented to the Council; <br />WHEREAS, the Agency has selected Creekside Center Associates as Master <br />Developer for the proposed upscale retail center at 960 San Leandro Boulevard, based <br />upon the Agency's determination that Creekside Center Associates has the necessary <br />expertise, skill and abilitv to carry out the commitments contained in the Disposition <br />and Development Agreement ("Agreement") between the Agency and Creekside <br />Center Associates, which are in the best interests and will materially contribute to the <br />Project; and <br />WHEREAS, the parties have finalized the form of the Agreement by and <br />between Creekside Center Associates to provide for the disposition of the real <br />property at 960 San Leandro Boulevard to Creekside Center Associates for <br />consideration in the amount of 53,000,000, as may be adjusted by the terms of the <br />related promissory note and deed of trust; and <br />WHEREAS, Creekside Center Associates will develop the Creekside Center <br />upon execution of the Agreement, as previously agreed upon in the Agreement; and <br />WHEREAS, the Agreement provides that the Agency shall convey the parcel <br />which has previously been acquired by the Agency, which acquisition was in whole or <br />1 <br />
