(e) Along with the Construction Financial Plan, the Developer shall <br />provide a Project Budget. The Project Budget shall include all Project Budget <br />documents submitted to the construction financing leader. Construction costs shall <br />be based on an actual bid by a qualified contractor. The Developer shall include a <br />summary sheet of the Project Budget. <br />1.08 Final Tenant/Leasing Plan <br />At the time Developer is required to submit the Construction Plans to the <br />Agency pursuant to the Section 1.06 of this Agreement, the Developer shall submit a <br />final plan for the leasing of the Creelcside Center for approval by the Agency. The <br />Developer shall negotiate lease agreements for the grocery store, drug store, video <br />stores, a fine dining restaurant of 4,000-6,000 square feet equivalent to Crogan's <br />Restaurant and shall set forth the terms of such leases in the Tenant/Leasing Plan. <br />Signed lease agreements for the grocery store, drug store, video stores, and the fine <br />dining restaurant must be submitted to the Agency prior to close of escrow. <br />For five years from the date the grocery store tenant opens, any subsequent <br />changes in tenants shall be approved by the Agency, and such approval shall not be <br />unreasonably withheld. During that period, any assignment of the grocery store lease <br />to a new owner or operator shall be approved by the Agency. The Tenant/Leasing <br />Plan and all proposed tenants shall be approved or disapproved within thirty (30) <br />days of submittal of the Tenant/Leasing Plan to the Agency. If the grocery store <br />tenant ceases operation, the Agency shall approve any replacement occupant of the <br />space previously occupied by the grocery store tenant subject to the requirements of <br />Section 2(a) of the Development Concept Plan attached as Exhibit B to this <br />Agreement. Such approval shall not be unreasonably withheld. <br />1.09 Citv of San Leandro Approval. <br />At the time Developer submits its Final Development Plan to the Agency, <br />Developer shall apply to the City of San Leandro and, diligently pursue, and obtain <br />all pen -nits necessary for the construction of the Improvements. Developer <br />aclu-iowledges that execution of this Agreement by the Agency does not constitute <br />approval by the City of San Leandro, does not limit in any manner the discretion of <br />the City of San Leandro in the approval process, and does not relieve Developer from <br />the obligation to obtain all necessary permits, including building permits.
