City of San Leandro in connection with the processing and consideration of the City <br />permits and approvals contemplated by this section. The City will attempt to <br />expedite the processing of permits as it does with other customers. <br />1.10 Time for Construction. <br />The parties mutually agree that the goal is to begin construction on or about <br />November 1, 1997, but in no case later than 45 days after the close of escrow. The <br />construction to be performed shall be substantially completed within 12 months. The <br />Date of Substantial Completion of the Project is the date when: (i) Certificates of <br />Occupancy have been issued by the City for 90% of the leasable area; and (ii) final <br />inspection approval of the building shell permits has been granted. Any delay in start <br />of construction or completion of construction due to fire, earthquake, war, <br />environmental dispute, strike, or other cause beyond the reasonable control of <br />Developer shall extend the time in which said construction must be completed by the <br />length of such delay. <br />Article Two: AGENCY PRE -DISPOSITION REQUIREMENTS <br />2.01 Conditions Precedent. <br />Developer's obligation to purchase the Property is contingent upon the <br />conditions set forth below being waived or satisfied on or before the dates provided <br />for below. Developer may terminate this Agreement by written notice to Agency if <br />Developer determines that the conditions set forth in this Article have not been <br />satisfied by the events set forth herein, or the date or extended date provided for <br />herein for the satisfaction of such conditions. <br />The conditions provided for in this Article Two shall be deemed satisfied by <br />the date by which the particular condition is required to be satisfied, if the Developer <br />does not provide notice to the Agency by the date provided herein that Developer has <br />disapproved of such matter. <br />2.02 Soils and Hazardous Waste Investigation and Remediation. <br />Agency shall provide the Developer with a letter of case closure from the <br />Regional Water Quality Control Board within thirty (30) days after execution of this <br />Agreement. <br />Disposition and Development Page 8 <br />Agreement (Creekside Center) <br />7/23/97, 8/5/97, 8/11/97, 8/12/97 <br />
