Operation. Tenant shall initially stock and at all times maintain at the Facility adequate <br />inventories of food, beverages, equipment and supplies. <br />Section 5.2 Landlord's Use of Nonexclusive Areas <br />Landlord shall have the right to use the Nonexclusive Areas upon the terms and <br />conditions set forth in this Section 5.2. <br />Section 5.2.1 Frequency of Use <br />As additional consideration for Landlord's entering into this Lease, Landlord shall be <br />entitled to use the Facility, free of charge, for meetings, seminars, conferences, receptions, and <br />the like from time to time, subject to availability at the time Landlord's request is made as <br />provided in Section 5.2.2, for up to Fifty Thousand Dollars ($50,000.00) worth of such use in <br />any calendar year at prevailing rates (peak or nonpeak, as the case may be). Such allowed use <br />shall include meeting rooms, audio visual equipment, overhead projectors, 35 mm projectors, flip <br />charts, white boards, and amplification, but shall exclude food and beverage service. Said <br />amount shall be increased annually in proportion to the annual increase in Tenant's schedule of <br />rates and charges for such Facilities and services. Any unused balance remaining at the end of <br />any calendar year shall not carry forward to the succeeding year. <br />Section 5.2.2 Schedule of Use <br />If Landlord desires to use the Facilities as set forth in Section 5.2.1, Landlord, acting by <br />and through its City Manager or authorized designee, shall notify Tenant of such desire not less <br />than sixty (60) days prior to the date Landlord intends to use the Facilities. <br />LEASE BETWEEN CITY OF SAN LEANDRO <br />AND SAN FRANCISCO BAY CONFERENCE RESORT <br />PAGE 28 <br />002574.0001\409817.4 <br />
