Section 5.2.3 Community Use <br />In addition to the use set forth in Section 5.2.1, Tenant agrees to provide community <br />nonprofit groups and organizations acceptable to Tenant with the use of meeting rooms in the <br />Premises without meeting room charge for up to thirty (30) events each year. Booking of such <br />community events is subject to availability at the discretion of Tenant and advance reservation, <br />and shall be held only at nonpeak times. Any balance of time remaining at the end of each year <br />shall not carry forward to the succeeding year. <br />Section 5.2.4 Public Access <br />In addition to use of the Nonexclusive Areas by Landlord and community nonprofit <br />groups and to the rights of the general public to use the Public Areas in accordance with Section <br />5.4„ Tenant shall provide the general public with access to those portions of the Premises and <br />Improvements designated on Exhibit E attached hereto. <br />Such public use and enjoyment shall be subject to Tenant's right to establish and enforce <br />reasonable regulations, areas of restricted access, and reasonable restrictions on use (such as, but <br />not limited to, skateboarding, camping, sleeping, picnicking, ball playing, sunbathing, playing <br />musical instruments, and the like). With regard to any such public access areas within the <br />Premises or that require access through the Premises, Tenant may limit the hours of general <br />public access to Tenant's normal operating hours of the conference center portion of the Facility. <br />If necessary, Landlord will adopt and use reasonable efforts to enforce reasonable rules and <br />regulations governing public use and conduct at the San Leandro Marina and in the vicinity of <br />the Premises to ensure Tenant's quiet enjoyment of the Premises.
