exclusive right to use the Primary Parking in connection with Tenant's operation of the Facility <br />and shall have the non-exclusive right to use the Overflow Parking in connection with Tenant's <br />operation of the Facility, together with use of the Overflow Parking by the general public. <br />With respect to the Primary Parking, there shall be included as part of the Public <br />Improvements the design and construction of such parking. Tenant shall clean, restripe, maintain <br />and operate such parking during the Term. Tenant may charge its guests and invitees for the use <br />of the Primary Parking and such charges shall be considered part of Gross Revenues. Landlord <br />shall be responsible for periodic repairs of the Primary Parking areas such as slurry sealing, crack <br />sealing, resurfacing and overlay. The Overflow Parking and the Marina Parking shall be <br />operated, maintained and repaired exclusively by Landlord. No modifications of the overall <br />layout, designation, striping and use of any parking areas shall be undertaken by Tenant without <br />written consent of Landlord. <br />Section 5.4 Tenant's Use of Public Areas <br />In addition to Tenant's rights with regard to the parking areas as provided in Section 5.3, <br />Tenant shall have the nonexclusive right to use the Public Areas and the Public Improvements in <br />connection with Tenant's use and operation of the Facility. The general public shall also have <br />access to and the right to use the Public Areas and the Public Improvements, provided that, if <br />necessary, Landlord will adopt and use reasonable efforts to enforce reasonable rules and <br />regulations governing public access to and use of the Public Areas and Public Improvements as <br />may be necessary to permit Tenant to operate the Facility in a reasonable manner.
