County. In the event of any violation of this Section 5.3, Landlord shall have the right, in <br />addition to other available remedies, to have included in the calculation of Gross Revenues for <br />purposes of determining Percentage Rent due under this Lease the gross revenues (as defined in <br />this Lease) of the business operation or facility causing such violation. As used in this Section, <br />"Affiliate" shall mean any individual, corporation, partner, partnership, limited liability company, <br />trust or other entity that directly or indirectly controls, is directly or indirectly controlled by, or is <br />under common control, whether direct or indirect, with the specified entity. As used in this <br />Section, "control" or "controlling" means the possession, direct or indirect, of the power to direct <br />or cause the direction of the management and policies of an entity whether through ownership of <br />an interest therein, through ownership of voting securities, by contract or otherwise. <br />Section 5.3 Parki <br />On the Public Areas located outside of the boundaries of the Premises and adjacent to <br />such Public Areas are lands devoted to parking. The total parking layout for these lands is set <br />forth in Exhibit F attached hereto. There are three (3) separate categories of parking, located as <br />shown on Exhibit F: (i) primary parking for the exclusive use of Tenant, its guests and invitees <br />(the "Primary Parking"); (ii) overflow parking for Tenant's non-exclusive use, together with the <br />general public (the "Overflow Parking"); and (iii) marina and visitor parking for members of the <br />general public using the Improvements who are not guests or invitees of Tenant and for use of <br />the marina by berthers and the general public, which marina and visitor parking shall not be used <br />by Tenant or the guests or invitees of Tenant (the "Marina Parking").
