condition and (ii) Landlord shall be responsible for the cleaning, maintenance and repair of the public restrooms located outside of the Premises. Landlord shall be responsible for any repairs or replacements to such public access walkways, roadways and restrooms located outside of the Premises unless necessitated by the acts or omissions of Tenant or its employees, contractors, representatives or invitees, in which event Tenant shall be responsible therefor. In addition to Tenant's obligation to maintain all landscaping located on the Site, Tenant shall maintain, in accordance with the Standard of Maintenance, any and all landscaping located south of the Site to the end of Mulford Point. With regard to those Improvements located outside of the area of the Premises, Tenant shall have a right of access to and upon the areas on which such Improvements are located as reasonably required for purposes of the construction, maintenance and repair of such Improvements. Section 7.2 Furnishings Reserve Account Tenant shall at all times during the Term maintain a segregated reserve account in a sinking fund with a banking institution acceptable to Landlord (the "Furnishings Reserve Account"). Within sixty (60) days after the end of each calendar year in which the Facility is open for business, Tenant shall deposit into the Furnishings Reserve Account an amount equal to one percent (1 %) of the Gross Revenues for the immediately preceding calendar year; provided that at no time shall Tenant be obligated to maintain more than Five Hundred Thousand Dollars ($500,000) (including accrued interest) in the Furnishings Reserve Account.
