limited to, any maintenance, repairs, or other work performed by City to Agency building or grounds. Agency agrees to indemnify, hold harmless and defend the City of San Leandro, its officials, officers, employees, and agents from and against any and all claims, liability, loss, damage or expenses resulting from allegations of negligent design, construction, repair or maintenance of the structure and facilities comprising the Agency premises, excluding therefrom, however, claims, liability, loss, damages or expenses relating to repairs or maintenance made by the City upon the Agency pool. City is permissibly self -insured for liability and property damage with a self -insured retention of One Million Dollars ($1,000,000.00). City's obligation hereunder to indemnify, hold harmless and defend the Agency, its property, directors, offices, and employees shall not be limited by the limitations of any contract of insurance held by City and any self -insured retention or deductible applicable to City's liability insurance shall not serve to reduce City's liability in full to Agency for any claim, loss, liability, or damages arising under this Section.
