4. During the continuance period, Councilmember Polvorosa, the City Manager and staff <br />continued to work with the involved parties towards developing a compromise. <br />5. After several months of negotiations, the parties reached a compromise agreement. <br />6. At the October 20, 1997 City Council meeting, following review of the record, oral and <br />documentary evidence and having taken official notice of the records of the City including prior <br />proceedings of the Council, the City Council makes the following decision: <br />• Site Development Approval SD 75-44 shall be modified as follows. <br />• The pedestrian and vehicle gate shall be closed from 8:00 p.m. to 6:00 a.m. <br />• The vehicle gate will remain exit only. <br />• The pedestrian gate will allow ingress and egress from 6:00 a.m. to 8:00 p.m. <br />• The tire spikes in the driveway shall be removed to permit emergency vehicle access. <br />7. This action by the City Council reflects the compromise agreed to by both parties. <br />8.
