(The mediator's conclusions regarding the <br />negotiations are presented in a memo dated June 30, 1996.) <br />By letter of June 6, 1996, the petitioners indicated that while they appreciated Mr. <br />Sullivan's efforts, they remained unsatisfied with the situation. They therefore asked the City to <br />proceed with their request that the approval be reconsidered. <br />PROCEDURAL HISTORY OF CITY'S MODIFICATION <br />A petition signed by 59 residents of Harold Avenue and dated February 26, 1996 seeking <br />reconsideration and/or revocation of the Approval was received by the City of San Leandro. The <br />residents cited problems with traffic, speeding, impacted on -street parking, littering and illicit <br />activity in their petition. Following mediation of the problem between petitioners and Mr. <br />Sullivan, petitioners continued to find the situation unsatisfactory and requested that the Council <br />move forward with its reconsideration of the permit. <br />Because of the nature of the problem, the staff referred the matter to the Planning <br />Commission so that it could make findings and a recommendation for action by the City Council, <br />pursuant to San Leandro Zoning Code Section 5-2906, Subsection (A) of Section 5-2906 states: <br />Upon determination by the Zoning Enforcement Official that there are reasonable <br />grounds for revocation of a use permit, variance, development plan approval, or <br />other discretionary approval authorized by this Code, a revocation hearing shall be <br />set by the Zoning Enforcement Official before the Board of Zoning Adjustment, <br />the Site Development Sub -Commission, the Planning Commission or the City <br />Council, whichever took final previous action on the permit, except for appeals. <br />The person or body that conducts the hearing allowed by Section 5-2906 A, may <br />revoke the permit at issue upon making one or more of the following findings: <br />1. That the permit was issued on the basis of erroneous or misleading <br />information or misrepresentation; <br />G:UOANN\SMORrMRESFINDC. CC <br />
