2. That the terms or conditions of approval of the permit have been violated or that <br />other laws or regulations have been violated; <br />That there has been a discontinuance of the exercise of the entitlement <br />granted by the permit for 180 days; <br />4. That the approval has been so exercised to constitute a public nuisance or be <br />detrimental to public health and safety. <br />The Planning Commission's Staff Report, dated July 5, 1996, states: <br />The current Traffic Engineer concurs with the conclusions reached in a 1977 <br />report by the traffic Engineer that because of the high volume of traffic on Washington Avenue, <br />the Harold Avenue exit provides a much safer means of accessing the complex. The current <br />Traffic Engineer also concurs with the 1977 Traffic report finding that the circulation plan now <br />in place on the site, which permits entry to the complex only from Washington Avenue and exits <br />onto both Harold and Washington Avenues is the most practical plan. <br />2. Some of the petitioners complaints were difficult to verify. Access to and from <br />the complex via Harold Avenue contributed to increased traffic and parking on Harold Avenue. <br />While staff did note litter on Harold Avenue, they could not determine the source of the litter. <br />Likewise, staff noted that it was difficult for them to verify complaints regarding noise. <br />3. The petitioners' complaints echoed those raised some 20 years ago when the <br />matter was first before the Site -Development Subcommission, Planning Commission and City <br />Council. <br />4.
