SAN LEANDRO ADMINISTRATIVE CODE TITLE 12 PUBLIC WORKS Chapter 5 Uniform Wastewater Discharge Regulations unusually high measurement if it is judged to not be representative of a user's long- term use of the wastewater system and/or can be explained by a one-time event. User charges shall include a demand charge and a loading charge. Demand charges shall be based on the average day (using normal work days) for the peak month discharge for the prior fiscal year or on an estimate of peak month parameters as provided for in subparagraph (d) below. If a User elects to submit an estimate of this peak month demand rather than use the prior year's peak month, the User must demonstrate to the Director's satisfaction that the User has or will soon implement substantial changes in plant processes which are likely to result in substantial reductions in the peak month discharge. Otherwise, the prior year's peak month demand shall be used to assess demand charges for the following fiscal year. The monthly demand charge will remain constant throughout the fiscal year except as provided for in subparagraph (d) below and shall be obtained by multiplying the quantity of each billing parameter (for the average day of the peak month) by the appropriate unit cost shown below.
