IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO.2022-119 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO <br />AUTHORIZE THE CITY MANAGER TO EXECUTE A NON-PROFESSIONAL <br />SERVICES AGREEMENT WITH BAY AREA TREE SPECIALISTS FOR HIGH <br />MAINTENANCE TREE TRIMMING IN AN AMOUNT NOT -TO -EXCEED $54,329; <br />AND TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE <br />CUMULATIVE CHANGE ORDERS UP TO 25% OF THE ORIGINAL <br />CONTRACT AMOUNT <br />WHEREAS, a draft agreement between the City of San Leandro and Bay Area Tree <br />Specialists was presented to this City Council; and <br />WHEREAS, Change Orders to modify bid quantities or to respond to unexpected <br />conditions are a normal aspect of public contracting; and <br />WHEREAS, Bay Area Tree Specialists has agreed to the terms of the contract pending <br />Council approval; and <br />WHEREAS the City Council is familiar with the contents of the agreement; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />NOW, THEREFORE, the City of San Leandro City Council hereby RESOLVES as <br />follows: <br />That said agreement substantially in the form presented is hereby approved and execution <br />by the City Manager is hereby authorized; and <br />That the City Manager is authorized to negotiate and approve cumulative change orders up <br />to a maximum of 25% of the original contract amount, or $13,582; and <br />That $54,329 will be re -appropriated from the FY 2021-2022 to the FY 2022-2023 budget <br />from Account 010-33-001-5340, and <br />That an original executed agreement shall be attached to and made a part of this resolution. <br />Introduced by Councilmember Lopez and passed and adopted this 181h day of July 2022, <br />by the following vote: <br />Members of the Council: <br />AYES: Councilmembers Aguilar, Azevedo, Ballew, Lopez, Simon, and Mayor Cutter (6) <br />NOES: None (0) <br />ABSENT: Co u cil ember Cox <br />ATTEST: 04, S <br />Kelly B.
