� 1 S <br />ACTIA 2002-26.01 <br />SECTION I <br />SPONSOR AGREES: <br />(1) Environmental, engineering, utility, right-of-way and construction work eligible under <br />the ACTIA "Policy on Eligible Costs" as shown in EXHIBIT "D" (attached hereto and <br />incorporated herein by reference), Appendix A, will be invoiced on a reimbursable basis for all <br />PROJECTS. <br />(2) That all costs related to PROJECTS in excess of the amount of ACTIA's contribution <br />indicated in the PLAN, as escalated to the year of expenditure based on the California Highway <br />Construction Cost Index (CHCCI), will be the responsibility of the SPONSOR for all <br />PROJECTS. <br />(3) That ACTIA funds programmed for PROJECTS are subject to annual modification in the <br />ACTIA Strategic Plan and these funds are subject to availability. <br />(4) That funds expended for work on PROJECTS prior to this AGREEMENT will not be <br />reimbursed unless prior agreement has been reached with ACTIA regarding the use and <br />monitoring of these funds. In all cases, reimbursable costs will be limited to those costs included <br />in EXHIBIT "D", Appendix A, "Policy on Eligible Costs". In no case shall funds expended <br />prior to November 7, 2000 be reimbursed. <br />(5) To meet with ACTIA prior to ACTIA funding any portion of the PROJECTS and to <br />assist in the preparation of the SPECIFIC AGREEMENT. SPECIFIC AGREEMENT shall <br />include but not be limited to the following information developed by SPONSOR: <br />• Detailed PROJECT description including a map. <br />• Detailed PROJECT schedule <br />• PROJECT cost estimate <br />• PROJECT PHASE cost breakdown <br />Preliminary Engineering <br />Environmental Studies <br />Final Design (PS&E) <br />Right of Way — Support <br />Page 4 <br />
