, 14 <br />ACTIA 2002-26.01 <br />(4) To provide an independent annual audit of ACTIA's program -wide revenues and <br />expenditures including the allocation formula for distributing Measure B sales tax revenues to <br />SPONSOR and render an annual report to ACTIA's Governing Board and to the Citizens <br />Watchdog Committee (CWC) within 180 days following the close of the fiscal year. <br />(5) To provide notice to the SPONSOR of any and all expenditures made by SPONSOR, <br />which are not in compliance with the AGREEMENT, the PLAN or the Measure B ballot <br />measure, promptly after ACTIA becomes aware of any such expenditures. <br />(6) To assist SPONSOR in preparing detailed schedules for all PROJECTS for inclusion in <br />the SPECIFIC AGREEMENT. <br />(7) To prepare contract language regarding Progress Reports suitable for inclusion in <br />SPONSOR's contracts for professional services. <br />(8) To prepare a contract specification/provision to be included in SPONSOR's construction <br />contracts to clarify ACTIA LBE/SLBE requirements, where such participation is required, and <br />monthly reporting requirements. <br />SECTION III <br />IT IS MUTUALLY AGREED AS FOLLOWS: <br />(1) It is the intent of ACTIA to commit Measure B Funds to fully funded PROJECTS. It is <br />the responsibility of SPONSOR to secure all other funds required to complete PROJECTS. If in <br />the opinion of the ACTIA Executive Director, a project has lost required funding or has not <br />progressed according to the detailed schedule as either shown in EXHIBIT `B" or as later <br />modified in the SPECIFIC AGREEMENT, funds may be withheld and may require <br />reimbursement from the SPONSOR to ACTIA. <br />(2) All correspondence and communications will contain the ACTIA number and name for <br />PROJECTS in a clearly identifiable location. <br />Page 10 <br />
