provided that the remainder of this Agreement, absent the unexcised portion, <br />can be reasonably interpreted to give effect to the intentions of the parties. <br />3.0 8 Amendments. This Agreement is not subject to modification or <br />amendment, except by a writing executed by both Agency and District, which <br />writing shall expressly state that it is intended by the parties to amend the <br />terms and conditions of this Agreement. <br />3.09 Whole Agreement. This Agreement has 16 pages excluding any <br />exhibits described herein. This Agreement constitutes the entire <br />understanding and agreement of the parties.
