RE:1273 4 571 <br />If <br />unreasonably interfere with City's use of said strip of land for street purposes. <br />City shall construct and maintain its street within said strip of land so as <br />not to reduce the vertical clearance between said existing electric transmission <br />lines and the ground thereunder below the minimum requirements set forth in <br />General Order No. 95 of the Public Utilities Commission of the State of California. <br />No tools, machinery, equipment, or materials shall be moved or operated within <br />six feet of any wire in any of Pacific's existing electric transmission lines. <br />Violation thereof is made a misdemeanor by Section 385 of the Penal Code of the <br />State of California. <br />Insofar as it can legally do so, City shall indemnify Pacific against and <br />hold it harmless from any and all loss, damage, and liability for damages, whether <br />for damage to or loss of property, or injury to or death of person, which shall <br />in any way arise out of or be connected with City's operations hereunder, unless <br />such damage, loss, injury, or death shall be caused solely by the negligence of <br />Pacific. <br />The foregoing grant is made subject to the right of way and easement for an <br />underground storm drain granted by Pacific Gas and Electric Company to Alameda <br />County Flood Control and Water Conservation District by deed dated August 24, 1962. <br />The provisions hereof shall inure to the benefit of and bind the respective <br />successors and assigns of the parties hereto. <br />IN WITNESS WHEREOF the parties hereto have executed these presents in <br />duplicate this 7 day of , <br />Yc47 <br />PACIFIC GAS AND ELECTRIC COMPANY <br />By / / <br />Its Vice- es'dent and Assis nt Ge al Manager <br />And By <br />Its al <br />I YYYJ �^�� Y CITY OF SAN LEANDRO <br />By <br />_V <br />A '1 �� 8'78 <br />East Bay <br />Dwg. <br />City of San Leandro <br />302 ea. <br />0 <br />-2- <br />
