If <br />s <br />PE'. 335 !M: 34 <br />leaving the last said line north 62' east Four Hundred <br />Seventy-nine and 34/100 feet to the Southwestern line of <br />Washington Avenue; and thence North 28' West along the <br />last named line Twenty Feet to the point of beginning; <br />BEING a strip of land Twenty feet in width lying along the <br />Northerly line of the property described in the Decree of <br />Distribution in re estate of Sarah M. Mathews, deceased, <br />and rerecorded in Volume 1206 of Deeds, at page 1, Records <br />of Alameda County, California, <br />for the total price or sum of One Hundred Forty-six Thousand, Nine <br />Hundred Thirty Dollars ($146,930) payable as follows: <br />A The sum of Fourteen Thousand Dollars ($14,000) to be <br />paid July 1, 1963, to Seller by Buyer. <br />B The sum of One Hundred Thirty-two Thousand Nine Hundred <br />Thirty Dollars ($132,930) to be paid by Buyer to Seller <br />on or before June 30, 1964. <br />2. Seller agrees to execute and deliver to Buyer at the time <br />of the payment of said $14,000 on July 1, 1963, a good and sufficient <br />deed conveying said property free and clear of all liens and encum- <br />brances of any nature. <br />3. Possession of said property shall be delivered by Seller <br />to Buyer as of July 1, 1963, subject to the provisions of Paragraph 4 <br />hereof. <br />4. The parties agree that Seller shall have the right to remove <br />from said premises all salvageable tanks located thereon. Said tanks <br />shall be removed by Seller on or before September 1, 1963 <br />5. Taxes and insurance shall be prorated as of July 1, 1963. <br />6. Seller agrees to procure from North American Title Insurance <br />Company at the time of or prior to the initial payment due Seller <br />hereunder, a policy of title insurance insuring Buyer to the full <br />amount of the purchase price for said property against loss or damage <br />by reason of defect in the title of the Seller to the above -described <br />premises, or by reason of prior liens. The cost of said policy of <br />title insurance shall be paid by Buyer. <br />AU115 /02 <br />- 2 - <br />
