Grastoke, nevertheless, desires that the street widen- <br />ing program of the City of San Leandro be promptly accomplished <br />and Grastoke is satisfied to close the transfer of the six parcels <br />needed by the City in consideration of the agreements of the City <br />as hereinafter provided. Accordingly, this agreement sets out <br />the terms and conditions on which the transfer of the six parcels <br />to the City by Grastoke will be accomplished in execution of the <br />agreement of April 6, 1962. <br />AGREEMENT: <br />NOW, THEREFORE, in consideration of the premises and <br />the terms and conditions of this agreement, IT IS MUTUALLY AGREED <br />between the parties hereto as follows: <br />(1) Grastoke and the City agree that the parcels of <br />land known as LD-60-164 and LD-60-165 (as the descriptions there- <br />of have been modified in accordance with recommendations of Murray - <br />McCormick, registered engineer, and the Engineering Office of the <br />City of San Leandro) are required in the public interest to pro- <br />vide motor vehicle parking space outside the established lanes <br />for the flow of traffic along Washington Avenue and Floresta <br />Boulevard. During the term of this agreement, Grastoke agrees <br />to improve and to maintain those areas as space for motor vehicle <br />parking, without cost or expense to the City and to its reasonable <br />satisfaction; maintenance will be at least equivalent to that of <br />the adjacent parking areas provided for customers of Grastoke and <br />its lessee on the store property adjoining Floresta and Washington. <br />- 2 - <br />
