Switzer, Secretary <br />Perking Association of Downtown : ic�rcra:its <br />c/o Chamber of Co -murce <br />San I&andro, California <br />Lear Bill i <br />The request of the Downtown Merchants Association to have the City <br />paint the marker lines on the Callan Avenue park_inR_ lot ,-Las been reviewed <br />by our s taff. <br />The existing lease with the Association specifies that the Second <br />arties (Lowntown Merchants Association and "Estudillo Chapel") shall pay <br />"....all maintainenee and repair costs, operation costs, lighting and water <br />charges, and all other charges and costs normally encountered in the opera- <br />tion of an off-street oarkinr lot." `The lease goes on to read "The entire <br />costs of maintenance and operation of the devised premises durint- the term <br />hereby created shall be borne by Second Parties." The quoted sections are <br />from namranhs 2 and 5, resnectively, of the lease ap•.roved by the City of <br />;.� San Leandro by hesalution 2U2 C.H.S., dated July 6, 195L. <br />You will a!-ree, I am sure, that the foregoing makes the City's posi- <br />tion clear. The City cannot, in direct renly to the request of the associ- <br />ation, enrage in repair and maintenance work as requested. <br />Should the association desire to make direct inquiry to the City Coun- <br />cil in this matter, it is, of course, perfectly free to do so.
