Said designation shall be made <br />by CITY at the time of approval of plans for the arrangement of <br />ground level parking facilities. <br />8. NON -LIABILITY OF CITY <br />ATC agrees to hold harmless and indemnify CITY, its officers, employees <br />and agents from and against any and all claims, actions and liability <br />or injury to persons or damage to property arising from or in any way <br />connected with ATC's occupancy hereunder or from its use of the <br />PREMISES during the term hereof. <br />9. ATC TO CARRY LIABILITY INSURANCE <br />ATC shall procure and maintain in force during the term of this Lease <br />a policy of public liability and property damage insurance approved <br />by the City Attorney adequate to protect against liability for <br />damage claims arising out of accidents occurring in or around said <br />PREMISES, which arise out of or are in any way connected with ATC's <br />occupancy or use of the PREMISES, with limits of $300,000.00 for <br />injury to any one person, $500,000.00 for any one accident or <br />occurrence and $50,000.00 for property damage; said policy shall <br />name the CITY OF SAN LEANDRO and all of its officers, employees and <br />agents as additional insureds. <br />10. NON -LIABILITY OF ATC <br />CITY agrees to hold harmless and indemnify ATC, its officers, employees <br />and agents from and against any and all claims, actions and liability <br />for death of or injury to persons or damage to property arising from <br />or in any way connected with CITY's construction in or use of the <br />airspace above the PREMISES or arising out of or in any way connected <br />with the use of the means of access, described in paragraph 7 hereof, <br />by parties other than, or which do not involve the negligent act or <br />conduct of, ATC, its assigns, licensees or invitees. <br />11. CITY TO CARRY LIABILITY INSURANCE <br />CITY shall procure and maintain in force during the term of this <br />Lease a policy of public liability and property damage insurance as <br />approved by ATC adequate to protect against liability for damage <br />lz/19/72/s -3- <br />
