I In the event that City determines that the lowest and best bid -for <br />doing the work is the lowest bid submitted for doing the work in the third <br />alternate described herein, and Owner concurs with such determination: <br />A. Owner shall pay to City at the Finance Office, City Hall, not later <br />than April 6, 1970, a sum constituting his fair and reasonable share <br />of the cost of preparation of plans and specifications, doing the work <br />and inspection of the work, said sum to be determined as follows: <br />1. A percentage of the amount of the lowest bid received for the <br />third alternate described herein, which percentage shall be <br />calculated by dividing the successful bidder's bid for the <br />second alternate described herein by the sum of the successful <br />bidder's bid for the first and second alternates described <br />herein; plus <br />2. The difference, if any, between the lowest bid received for the <br />first alternate described herein and the balance of the amount <br />of the lowest bid received for the third alternate described <br />herein after deducting therefrom the percentage calculated in <br />Paragraph 1 above; plus <br />3. An additional ten percent (10%)of the sum of the amounts calculated <br />in Paragraphs 1 and 2 above as Owner's share of the cost of <br />preparation of plans and specifications and inspection of the work. <br />II In the event that: <br />A. City determines that the lowest and best bid for doing the work is <br />the lowest bid submitted for doing the work in the first alternate <br />described herein; or <br />B. Owner does not concur with City's determination that the lowest and <br />best bid for doing the work is the lowest bid submitted for doing the <br />work in the third alternate described herein; or <br />C. Owner fails to pay at the time and place prescribed the amount determined <br />in Paragraph 1 above; or <br />D. City rejects all bids, <br />- 2 - <br />
