CITY of SAN LEANDRO <br />JUL 2 51985 <br />LEASE CITY CLERK'S OFFICE <br />BETWEEN THE CITY OF SAN LEANDRO AND <br />DINO T. CACIOPPO AND MARJORIE R. CACIOPPO <br />Recitals <br />1. LYAL NICKALS and CALLIBELLE NICKALS, his wife ("Owners") and <br />DINO T. CACIOPPO and MARJORIE R. CACIOPPO, his wife ("Tenants") entered <br />into a lease agreement on June 1, 1982. The parties hereto are DINO T. <br />CACIOPPO and MARJORIE R. CACIOPPO ("Tenants") and the CITY OF SAN LEANDRO, <br />a municipal corporation ("City"). <br />2. The City of San Leandro became the owners of the property <br />described in the "Real Property Purchase Contract - City of San Leandro" <br />attached hereto as Exhibit A, on April 4, 1985. <br />3. Under -the lease dated June 1, 1982, between Lyal Nickals and <br />Callibelle Nickals, and Dino T. Cacioppo and Marjorie R. Cacioppo, attached <br />hereto as Exhibit B, Tenants leased the property commonly known as 16099 <br />Hesperian Boulevard, together with all improvements and appurtenances per- <br />taining thereto. <br />4. Tenants have quitclaimed their interest in the property known <br />as 15099 Hesperian Boulevard to the City of San Leandro by quitclaim deep <br />dated June 18, 1985, recorded by Alameda County Recorder dated July '19, 1985. <br />NOW, THEREFORE, in consideration of the mutual promises contained <br />herein, the parties hereto agree as follows: <br />A. City hereby leases to Tenants the property commonly known as <br />15099 Hesperian Boulevard, San Leandro, together with all improvements and <br />appurtenances pertaining thereto, upon the terms and conditions contained <br />in Exhibit B, except that the rental rate shall be $2000 per month and the <br />term of the lease shall commence on July 23, 1985, and shall terminate no <br />later than August 5, 1985. <br />
