-2- <br />B. Failure of the Tenants to physically vacate the property by <br />August 5, 1985, will result in damages being sustained by the City. Such <br />damages are, and will continue to be, impracticable and extremely difficult <br />to determine. For each consecutive calendar day in excess of August 5, 1985, <br />the Tenants shall pay to the City, or have withheld from monies due it, the <br />sum of $1,000. <br />Execution of this lease shall constitute agreement by the City and <br />Tenants that $1,000 per day is the minimum value of the costs and actual <br />damage caused by failure of the Tenant to physically vacate the property <br />within the allotted time, that such sum is liquidated damages and shall not <br />be construed as a penalty, and that such sum may be deducted from payments <br />due the Tenants, if such delay occurs. <br />Dated: -Z3 <br />Approved as to form: <br />S <br />Steven Meyers, City Attorney <br />CITY OF SAN LEANDRO <br />BY: <br />C <br />Dino T.
