California March 14 , 19 85 CALLIBELLE NICKALS Grantor REAL PROPERTY PURCHASE CONTRACT - CITY OF SAN LEANDRO page- 1 -i 3 -f EXHIBIT A On this date, Grantor has executed and delivered to Kevin M. Cassady, Chief Right of Way Agent, County of Alameda, acting on behalf of the City of San Leandro, the following documents: (a) Grant Deed, City Parcel 15 (LD 84-90); (b) Grant Deed, City Parcel 16 (LD 84-91); (c) Permit to Enter upon remaining property at 15099 Hesperian Boulevard (LD 84-150), with expiration date of December 31, 1985; and (d) Permit to Enter upon portion of remaining property at 1104 Halcyon Drive (LD 84-148), with expiration date of December'31, 1985, covering the properties particularly described therein. In consideration of which, and the other considerations hereinafter set forth, it is mutually agreed as follows: 1. The parties have herein set forth the whole of their agreement. The performance of this agreement constitutes the entire consideration for said documents and shall relieve the City of San Leandro of all further obligations or claims on this account. 2. The City of San Leandro shall: (A) Pay the undersigned grantor the sum of $375,708.00 for the properties or interests conveyed by the above documents when title to the properties described in (a) and (b), above, vests in the City of San Leandro, free and clear of all liens, encumbrances, assessments, easements and leases (recorded and/or unrecorded), and taxes, except: a. Taxes for the fiscal year in which this escrow closes, which shall be cleared and paid in the manner required by Section 4986 of the Revenue and Taxation Code, if unpaid at the close of escrow.
