8. The undersigned grantor hereby agrees and consents to the dismissal <br />of any eminent domain action in the Superior Court wherein the herein described <br />land is included and also waives any and all claims to any money that may now <br />be on deposit in said action. <br />9. It is understood and agreed that the grantor shall eliminate to <br />the satisfaction of the below -named title company the effect of the following: <br />1. That certain lease referred to in Clause 5, above. <br />10. The payment shown in Clause 2(A) above, includes payment to <br />grantor for certain improvements located partly within and partly outside the <br />right of way area, and certain improvements located on the remaining property. <br />Said improvements consist of: one 1-story commercial building, <br />storage sheds, and greenhouse. The City of San Leandro and its authorized <br />agents, and contractors are hereby granted the right to enter upon the remaining <br />property of grantor for the purpose of removing said improvements, in addition <br />to the purposes stated in the Permits to Enter [items (c) and (d), page 1.] <br />11.
