IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 79 - <br />RESOLUTION OF NECESSITY AUTHORIZING THE ACQUISITION <br />OF CERTAIN PROPERTY AND FINDING THAT THE PUBLIC IN- <br />TEREST AND NECESSITY REQUIRE THE PROPOSED PROJECT, <br />THAT THE LOCATION THEREOF CAUSES THE LEAST PRIVATE <br />INJURY, THAT THE SUBJECT PROPERTY IS NECESSARY FOR <br />THE PROPOSED PROJECT <br />(RAJ Inc.) <br />Recitals <br />1. The Director of Public Works has recommended to the City Council <br />that certain parcel described in Exhibit A (attached hereto and incorporated <br />herein by this reference) be acquired by the City of San Leandro for public <br />use by this exercise of the power of eminent domain. <br />2. Pursuant to Chapter 4, Title 7, Part 3 of the Code of Civil Pro- <br />cedure, the Council passed Resolution No. 79 - 262 authorizing the giving of <br />notice of intent to adopt this resolution of necessity for condemnation. <br />3. In accordance with Resolution No. 79 - 262 the City Clerk has <br />given notice to persons required by law to be notified. <br />4. Written requests to appear have been received from: <br />(a) None <br />(b ) <br />(c) <br />5. Due consideration of all oral and documentary evidence introduced <br />has been given and official notice of the plans, specifications, reports, negative <br />declaration heretofore prepared or adopted has been taken; <br />
