CITY OF SAN LEANDRO STANDARD PUBLIC IMPROVEMENT AGREEMENT <br />700 MARINA BOULEVARD <br />THIS AGREEMENT entered into on September 1, 1981 by and between the CITY <br />OF SAN LEANDRO, a municipal corporation, hereinafter referred to as City, and <br />PRODUCTION PATTERN AND FOUNDRY COMPANY, hereinafter referred to as Owner. <br />It is mutually agreed as follows: <br />1. Construction of Public Improvements. In consideration of the grant- <br />ing of certain entitlements of use described as follows: Issuance of a building <br />permit to construct an additional building at 700 Marina Blvd. and the ultimate <br />acceptance by the City of the property described in Exhibit B herein (if appli- <br />cable) Owner agrees to deposit with the City the following sum $7,500.00, which <br />the parties agree, satisfies Owner's obligation to construct public improvements <br />in the area shown on the attached document, marked Exhibit A, incorporated herein <br />by reference, and further identified as Marina Boulevard Plan Line widening <br />requirements adjacent to 700 Marina Boulevard. Said improvements shall include <br />curb, gutter, sidewalk, street pavement and all other improvements required by <br />the Director of the Department of Public Works based upon the standards imposed by <br />Title 7, Chapter 17 of the San Leandro Municipal Code of 1957 and the Standard <br />Specifications adopted by the City of San Leandro for public works. <br />2. Time of Commencement. Construction of said improvements shall commence <br />at such time as the Director of the Department of Public Works, at his sole dis- <br />cretion deems it appropriate; provided, however, if the City commences construction <br />of said improvements prior to September 1, 1982 City shall return to owner that <br />portion, -if any, of above deposit which exceeds the prorated share of the project <br />costs attributable to the frontage of 700 Marina Bo�!Ievard. <br />
