8b-024176 <br />0 <br />WHEREAS, Paragraphs 4 and 5 of the aforementioned Agency Grant <br />Deeds contain conditions subsequent providing said Agency the right to <br />repurchase, reenter, reposses and revest in event of violation of the <br />provisions in said Deeds and DDA after conveyance and prior to <br />recordation of the Certificate of Completion; <br />NOW, THEREFORE, Agency and Redeveloper agree: <br />1. The Agency does hereby certify that the construction and <br />development have been fully and satisfactorily performed and completed <br />on the real property described in Exhibits "A" and "B". <br />2. Said conditions subsequent in the Grant Deeds have been fully <br />and satisfactorily performed and are of no further force or effect by <br />reason thereof. <br />3. That all sums, fees and expenses required by the terms of <br />said DDA, including, but not limited to, such obligations arising <br />from the Adjustment of the Initial Disposition Price, have been <br />tendered to the Agency and receipt thereof is hereby acknowledged by <br />the Agency. <br />4.
