All named Defendants having an interest in the subject property have <br />appeared in this action. <br />3. Defendants THE HEIRS AND DEVISEES OF W.C. FROST, aka <br />WILLIAM CHAPMAN FROST, Deceased, were dismissed from this action on <br />October 6, 1995, and have no interest or title in said property. <br />4. Defendant MAX A. MORRIS filed a First Amended Answer to <br />Complaint in Condemnation on or about October 2, 1995. <br />5. Said Defendant, having appeared in this action, is fully informed as to <br />all matters affecting said property and expressly waives any and all other process of <br />notice and any rights affected thereby. <br />6. That the Court is authorized and petitioned to enter without further <br />notice a Judgment in Condemnation and a Final Order of Condemnation, copies of <br />which are attached hereto a-� "Ru —.mot. -� , , decreeing that the <br />fee simple title in and to the property, more particularly described in Exhibit "A", is <br />taken and condemned as authorized by law and adjudging that the sum of <br />TWENTY-THREE THOUSAND FIVE HUNDRED DOLLARS ($23,500) is full, <br />adequate and just compensation for the taking thereof and any and all claims or <br />damages under the California Eminent Domain Law asserted by said Defendants. <br />7.
