Defendant shall deposit the sum set forth in <br />paragraph 2 hereof with Western Title insurance Company of <br />Hayward, California, and shall instruct Western Title Insurance <br />Company to pay defendants THERESA I. MATULA and ELIZABETH <br />THOMPSON, in care of Glen Forbes, attorney for said defendants, <br />from said deposit the amount of ONE HUNDRED FOUR THOUSAND <br />DOLLARS ($104,000.00) plus interest thereon from March 26, 1987, <br />to the date of recordation of the Final Order of Condemnation, <br />less the amount necessary to pay off the loan secured by the <br />deed of trust in favor of the BANK OF AMERICA NATIONAL TRUST AND <br />SAVINGS ASSOCIATION as beneficiary of that deed of trust on the <br />property recorded as Series 75686, Reel 4822 OR, Image 545. <br />Western Title Insurance Company shall further be instructed to <br />distribute the following sums for ordinary costs of suit: <br />(a) The sum of One Hundred Forty -Nine Dollars and <br />Fifty Cents ($149.50) to THERESA I. MATULA and ELIZABETH <br />THOMPSON, in care of Glen Forbes, 114 Parrott Street, San <br />Leandro, California, 94577; and <br />(b) The sum of One Hundred Forty -Nine Dollars and <br />Fifty Cents ($149.50) to BANK OF AMERICA NATIONAL TRUST AND <br />SAVINGS ASSOCIATION, in care of M. Chadwick Butler, 555 <br />California Street, 7th Floor, P. 0. Box 37000, San Francisco, <br />California 94137. <br />S. Possession having been taken by plaintiff on March <br />26, 1987, all taxes, penalties and costs which are a lien on <br />said property and which are apportioned to that portion of the <br />fiscal year after said date are hereby cancelled pursuant to <br />-3- <br />
