In addition, Plaintiff shall pay to said <br />2 Defendants the sum of Three Hundred Seventy -Three and No/100 <br />3 Dollars ($373.00) for costs of suit herein. <br />4 3. Plaintiff shall deposit the sums specified in <br />5 paragraphs 1 and 2 above with Placer Title Insurance Company of <br />6 San Leandro, California. Plaintiff shall instruct Placer Title <br />7 Insurance Company to pay the said sums to James J. Murray, <br />8 Trustee for EDWARD SOARES; ELLSWORTH SCARES; the heirs and <br />9 devisees of RAYMOND SCARES, deceased, and all persons claiming <br />10 by, through, or under said decedent; the heirs and devisees of <br />11 LEONARD SOARES, deceased, and all persons claiming by, through, <br />12 or under said decedent; and WILLIAM SCARES, upon recordation of <br />13 the Final Order of Condemnation. <br />14 4. Plaintiff will perform the following work on the <br />15 property described in Exhibit A and on the remainder at <br />16 Plaintiff's sole cost: removal of existing front steps and <br />17 construction of new steps, all as more particularly set forth in <br />18 Exhibit B, attached hereto and incorporated herein by reference. <br />19 Defendants will grant a right -of -entry to Plaintiff and its <br />20 contractors to go on the remainder to perform the work set forth <br />21 above. <br />22 5. The payment of the sum set forth in paragraph 1 <br />23 and the work to be performed pursuant to paragraph 3 shall be in <br />24 full payment for the real property or interest in real property <br />25 hereinabove described and for any and all damage of every kind <br />26 and nature accruing by reason of the acquisition of said <br />27 property and the construction and maintenance thereon of the <br />3 <br />
