Upon payment of said total sum set forth in <br />4 paragraphs 1 and 2, said real property shall be condemned to <br />5 Plaintiff and as against EDWARD SOARES; ELLSWORTH SCARES; the <br />6 heirs and devisees of RAYMOND SCARES, deceased, and all persons <br />7 claiming by, through, or under said decedent; the heirs and <br />8 devisees of LEONARD SCARES, deceased, and all persons claiming <br />9 by, through, or under said decedent; and WILLIAM SOARES, in fee <br />10 simple absolute, unless a lesser estate is described, and all <br />11 interests of said defendants in and to said property shall be <br />12 terminated. <br />13 7. The purpose for which said property is sought to <br />14 be condemned is a public use authorized by law and that the <br />15 taking is necessary for such use. <br />16 8. Possession having been taken by Plaintiff on <br />17 August 4, 1988, pursuant to an Order for Possession, all taxes, <br />18 penalties and costs which are a lien on said property and which <br />19 are apportioned to that portion of the fiscal year after such <br />20 date (the "date of apportionment") are hereby cancelled pursuant <br />21 to Revenue and Taxation Code § 4986.
